This comment, though, relates more to your discussion. Years ago I dated a Public Defender who defended only capital murder cases in Hillsborough County, FL. In their lighter moments (yes, of course, they engaged in gallows humor [no pun intended]) the would talk about jury nullification via the "Tennessee Two-Prong Test": 1. the right person died and 2. the right person killed them.
