I have read the opinion in Trump v. United States that was delivered by the most honorable Justices of the so called "conservative" majority of our Supreme Court. I now have my dissent in mind. It is short. It is a paraphrase of arguably our greatest former President and I hope he would approve:

After reading the Majority Opinion in Trump v. United States, it seems to that our progress in degeneracy has accelerated to a very fast pace. As a nation, we once declared that all Americans are equal under the rule of law and our Constitution. The supreme court has now declared: "all Americans are equal under the rule of law and no one is above the law, except for his Excellency, the President, "The Leader" and those who are in his favor, who are loyal to him and do his will and who will receive pardons if they commit crimes and atrocities while doing his will. Everyone else will be subject to the law, but only the law that He, The Leader who is "our retribution and our justice", declares it to be.

When it comes to this I should prefer emigrating to some country where they make no pretense being a democratic republic or upholding a Constitution or honoring the rule of law or loving liberty. I would prefer to move to Russia, for instance, where despotism can be taken pure, and without the base alloy of hypocrisy.

I am ready to support the Democrats candidates that will commit to expansion of the supreme court to 13 justices with all of the new members nominated and vetted by the party (Democrats) who will campaign on the promise to stop the right wing rampage that the Trump appointed justices are determined to continue.

Leader of the Heritage Foundation, Kevin Roberts, on 7/3/24: “We are in the process of the second American Revolution, which will remain bloodless if the left allows it to be”. All of these machinations are planned and purposeful towards authoritarianism. Make no mistake about it, we are already inside looking out. Clearly these powers gifted to Trump are to allow him to act decisively against his enemies, and they are us.

Maybe if every single journo and pundit and network spent the next month yelling and screaming about dotards mental instability and flat out crackpottery like they have on Joe we wouldn't be here.... damn near a decade later and they still treat him like a normal human being... faquing pathetic... he has played every single one of you like a fiddle.... bunchamorons can't see the forest from the trees....

I know these are not typical times, haven't been for near a decade, but I had come to expect and mostly appreciate the usual sober and realistic commentary and journalism on The Bulwark. However the last several days this platform has turned into the literal hair-on-fire-sky-is-falling freakout show! Basically EVERY SINGLE ARTICLE has predicted doomsday and demanded Biden retire immediately. I understand it's not looking good however any decisions have to be reasoned and based on something other than the political-class talking heads and their know-it-all assumptions... most people are NOT even politically engaged right now... from Kristol and Egger to Charen and Stoddard and Miller and what seems like every editorial board... all have crystal balls apparently.... I'll tell you this there isn't any other dem out there who can step in now and make any of you feel better about the presidential election! Take a breath and let's see some data and maybe, just maybe enough Americans will realize that unless they want a permanent theocracy governed by the fine-for-me but not-for-thee zealots then go with the sleepy old man who will at least have adults guiding us and not try and burn it all down!! Smh...

Then we might as well give up right now, because there is absolutely no reason to think Biden will win in November. He was hanging by a thread before the debate. Maybe a miracle will happen—the polls will turn in his favor. Maybe he’ll surpass expectations with the Stephanopolis interview. Until that happens, hair will be on fire, yes. Do not ask us to be satisfied with losing.

No reason to think any other dem can step in and win either.... so what's the plan??

We have elected officials to handle times like these. It’s not my job or yours to come up with “the plan”. Our job is to support the party and vote. Hopefully we will have a candidate that can actually win.

Everyone here *is* going with Biden, if he is on the ballot in November. It's the peckerwoods in the swing states that we're worried about.

Expand full comment

Right but who are those peckerwoods going for as a substitute.....??

Expand full comment

Many of those peckerwoods that voted for Joe in 20 are going to stay home this year if Joe is on the ballot. Also hurting down ballot candidates.

I don't disagree but who is the answer then??? 🤔 bc idk there is a definitive one....

I honestly believe there is enough dislike/hatred for Trump it won't make any difference if the person chosen can walk and chew gum. Oh and also is able to do an average or a little above job talking and answering questions without a teleprompter.

Did you listen to Biden's remarks on the Immunity decision? I did and he sounded fine to me. Sure it is a teleprompter but he is doing the job a president is supposed to do. Do you disagree with what Biden said? Did you agree with what Trump said? Is this Joe must go stampede just about a beauty contest? Gavin is younger and has a nicer voice and can more easily come up with zingers to foil Trump. Or is there some kind of policy difference or legislative action that we think Gavin can do better than Biden. Yea, I'll go with whoever gives the best chance of winning. But are we sure voters are that superficial and uninterested in their own lives? Or is it the pundits and newspaper editors and owners that just look at the beauty contest?

Question...

If President Biden deems Trump a grave threat to national security, can he have him locked up indefinitely, without a trial, and not face legal consequences for his action?

Yes, but Joe will not do it. More asymmetrical warfare.

Why don't we stop telling Biden to drop out, and start telling him to fight fire with fire? Trump and the other right wingers have totally corrupted the court. Biden should take advantage of what that means for him and use his newly bestowed kingly powers to shut Trump down. I don't know what that looks like (I'll let the smarter people come up with a plan), but he only has to do it once. Once he's elected again, he can reform the court and get back to some sort of reasonableness. I'm not opposed to doing something to the justices themselves. Thomas is guilty of bribery; his wife is guilty of treason; Alito is guilty of something, I just can't put a name to it.

I'm tired of Democrats going to gunfights with knives. We need to get our courts back from the Christofascists and Nazis in the GOP. We can do it within the bounds of the law as it now stands.

Under this new SCOTUS ruling, President could officially order the military to assassinate Trump, and face no charges for doing so. Is that what SCOTUS intended?

The Bulwark’s whole raison d’etre is to keep Trump out of political power - and they are being realistic about Trump. He is a cult leader. His party will not disown him. That being the case, he has to be kept out of office.

Time to face reality. The Republican Party has been taken over by a demigod and his Brownshirts. Even those in the party who know better are terrified of Trump and MAGA. They will stop at nothing until Trump becomes America’s Czar.

He must not be given control of the executive office. He belongs in jail.

Jail is too good for that sonovabitch.

If every official presidential act is legal, what does that mean for executive actions? Are they no longer subject to judicial oversight since they are official acts?

Expand full comment

The short answer is, SCOTUS is saying they will decide whether a POTUS can be prosecuted. They said core official acts are absolutely immune, other official acts are presumptively immune, official acts should be subjected to the broadest possible interpretation, private acts are not immune. But they did not define what any of that means or what acts might be which. They also said official acts cannot be used as evidence to prosecute private acts, and that courts cannot question the president's motives. A prosecutor would have to try define every act and every piece of evidence, articulate why they were all private, then send it to the supreme court to see if they agreed with the categorization of every action or piece of evidence as private. THIS SCOTUS will define those terms however they wish, depending, I assume, on their political preferences. I think in practical terms it makes any president immune from prosecution for acts committed while in office.

According to the NYT:

“Former President Donald J. Trump over the weekend escalated his vows to prosecute his political opponents, circulating posts on his social media website invoking “televised military tribunals” and calling for the jailing of President Biden, Vice President Kamala Harris, Senators Mitch McConnell and Chuck Schumer and former Vice President Mike Pence, among other high-profile politicians. Mr. Trump, using his account on Truth Social on Sunday, promoted two posts from other users of the site that called for the jailing of his perceived political enemies.”

SCOTUS de-ligitimizes itself. Do they really think that the first time they do not hand Trump a donut, he’ll bow to their findings, or is every case going to be another treat.
