I'm not so sure. He seems intent on setting up a situation where he simply ignores a Supreme Court ruling. When starting from the assumption that he's champing at the bit to defy the rule of law, why try to come up with a nuanced argument to circumvent the Constitution? If he wants to stay in the presidency, I think it's more likely he'll either: (1) just stay, and say "who's going to make me leave; or (2) let Vance run, wait until the election is over, declare there are too many irregularities and issues with the vote totals to honor the election, and maintain he'll have to stay in office until he can get to the bottom of the situation.
